Statutes of Limitations Tolled as a Result of COVID-19

As individuals and businesses struggle to process and address the impact of the pandemic outbreak on their business, Ohio’s Legislature has come to the aid of individuals and businesses alike to buy them more time with regard to actions that must be taken by certain statutorily or administratively created deadlines.

On March 26, 2020, House Bill 197 was forwarded to the Governor and was signed into law on Friday, March 27, 2020. The Bill, tolls any expiring administrative limitation or statute of limitation created under the Revised Code until July 30, 2020. The Bill is retroactive to March 9, 2020 and is designed to allow individuals or businesses additional time to assess, and/or take, any actions which may have been on the verge of expiring.

Additionally, for individuals or businesses already in litigation, the statute provides some additional relief from pending discovery cut-off and other pretrial deadlines.

The most immediate effect of this statute may come into play with regard to Board of Revision filing deadlines, that are set to expire March 31, 2020. Any business or individual who has taken a closer look at their real estate valuation issues as a result of this pandemic may wish to contact Mike Sandner at Pickrel, Schaeffer and Ebeling Co., L.P.A. to explore whether there is still an opportunity to pursue these claims even after the March 31, 2020 deadline as a result of the passage of House Bill 197.

Katie Wahl named a Principal with the Firm

Pickrel, Schaeffer and Ebeling is pleased to announce that Katie Wahl has been named a Principal with the firm. Katie has been practicing law for over 15 years and focuses on business and corporate law, as well as estate planning, probate (including estate administration and guardianships) and Medicaid planning. As a corporate and business lawyer, Katie focuses on the formation of new entities, assisting clients with the sale or purchase of a business, and succession planning for a business and its owners. She also has extensive experience in working with non-profit entities to obtain and maintain their non-profit status.

Katie is a 2003 honors graduate of the Notre Dame Law School. Katie also earned a Master of Arts in Economics from the University of Notre Dame and was the first in the school’s history to combine the two curricula into one program.

PS&E is proud to announce that Gabrielle R. Neal (Gaby) has recently joined our firm as an Associate. Gaby will be on our Business Law and Real Estate team where she will concentrate her practice on real estate, business, and municipal law.
As an attorney, Gaby has exceptional client communication and negotiating skills. She represents owners, investors and entrepreneurs in all aspects of business and commercial law. She understands the need for urgency and attention to detail when it comes to client matters. Gaby excels at contract drafting, review and negotiations; curing title issues; and assisting clients with real estate transactions.
Gaby graduated from the University of Dayton in 2014. While in law school she was a staff writer and editor of the Dayton Law Review. PS&E Welcomes Ebony D. Davenport

PS&E is proud to announce that Ebony Davenport recently joined our firm as an Associate. She will provide assistance to every area of practice throughout the firm.
While in law school, she was very active in student organizations while helping to improve the overall culture for both faculty and students. Ebony served in a variety of student-led organizations: she was a Dean’s Fellow during her second and third years of law school; she was a Comment Editor on Law Review; and she was the president of the Black Law Student Association. Ebony also served on two faculty-led committees: the Academic Appeals Committee, and the Diversity, Equity, and Inclusivity Committee. These experiences not only shaped her leadership skills, but also enhanced her interpersonal and collaborative skills.
A lifelong Daytonian, Ebony is excited to provide legal services to all residents of the Greater Dayton area. She is a Dayton Public School alumni (Thurgood Marshall High School), completed her undergraduate work at Sinclair Community College and Wright State University, and earned her law degree from the University of Dayton School of Law. Most recently, Ebony was accepted to the Dayton Bar Association Leadership Development Class of 2019-2020.

We are excited to announce the opening of an additional location in Troy, Ohio at 22 North Short Street right across from the Miami County Court House. President of Pickrel, Schaeffer and Ebeling, Michael W. Sandner has this to say about the additional location, “we are pleased to be able to offer a physical footprint to service our clients and neighbors in the Northern Miami Valley. We welcome and look forward to the opportunity to provide superior legal services to the residents of Miami County.” Attorneys Matthew C. Sorg and Katrina L. Wahl will be the lead attorneys in our Troy Office.
Matt has been with the firm for 11 years and practiced law 25 years. He spends the majority of his time offering legal services in all types of domestic relations matters, including dissolution, divorce, legal separations, custody, child support, spousal support, property division, prenuptial agreements, and parental rights. He also understands how to get qualified domestic relations orders (QDRO) issued to ensure pension funds are properly dealt with after divorce. Other business services that Matt provides on a regular basis include helping small businesses with formation, growth strategies, and the purchase or sale of a business. He has a great deal of experience with administrative law issues surrounding liquor establishments. Additionally, in a commercial foreclosure situation, Matt is a court appointed Receiver throughout Southern Ohio.
Katie focuses her practice on business and corporate law, as well as estate planning, probate (including estate administration and guardianships) and Medicaid planning. As a corporate and business lawyer, Katie has experience in forming new entities and assisting clients with the sale or purchase of a business, as well as drafting terms and conditions, contracts and other agreements. She also works with family owned and other closely held businesses to structure succession plans to prepare for transitions in management and ownership. Katie also has extensive experience in working with non-profit entities to obtain and maintain their non-profit status. A 2003 honors graduate of the Notre Dame Law School, Katie also simultaneously earned a M.A. in Economics from the University of Notre Dame.
