The Sixth Circuit of the U.S. Court of Appeals has issued an Order reversing the District Court’s grant of summary judgment and remanding the case back for further proceedings consistent with the Opinion of the Court. In Smith v. City of Union, 3:22-cv-00095, the District Court had ruled in favor of the City on Mr. Smith’s federal and state age discrimination and retaliation claims arising from his termination from employment and retaliation after an arbitrator reinstated him.
Mr. Smith appealed, and the Court of Appeals determined that, based on the particular factual record presented, material issues of fact exist that a jury can consider at trial. The case has been returned to the District Court for further proceedings. Mr. Smith is represented by Pickrel Schaeffer & Ebeling’s Matthew Stokely.
