Temporary Remote Document Inspection Flexibilities for Employer Form I-9 Ends on July 31, 2023

Federal law requires that every employer who recruits, refers for a fee, or hires an individual for employment in the U.S. must complete Form I-9, Employment Eligibility Verification. In March 2020, due to the Covid-19 health emergency, employers were permitted to defer in-person inspection of I-9 documents for workers hired to work remotely. The Department of Homeland Security (DHS) will end the temporary flexibilities granted during Covid-19 on July 31, 2023. Employers who were previously able to review I-9 documents remotely will now be required to review documents in person. Employers must complete all needed in-person physical document inspections by August 30, 2023, including in-person inspection of any previously inspected documents remotely during the Covid-19 flexibility period.

Employers can designate an authorized representative to complete their I-9 Forms and physically inspect eligible documents.
